Discussion on the Review of the Terms of Reference (TOR) of the AICHR

Findings made by FORUM-ASIA through its recent publication on the 10-year evaluation of  the ASEAN Intergovernmental Commission on Human Rights (AICHR) have indicated room for improvement that can be implemented by the regional human rights mechanism to be fully effective on addressing the human rights issues in the region, particularly when it comes to provide the protection for those whose rights are violated. One of the persistent messages brought by the research is the necessity to strengthen the AICHR by reviewing its Term of Reference (TOR).

The commitment of reviewing AICHR by the ASEAN Ministries of Foreign Affairs is stipulated in the Cha-Am Hua Hin Declaration on the Intergovernmental Commission on Human Rights 2009. According to the declaration, the TOR is subject to review by the ASEAN Ministries of Foreign Affairs in every 5 years. Therefore, reviewing the AICHR TOR in 2019 should be seen in compliance with the commitment made by ASEAN within the declaration.

It is under this circumstance that AICHR- Indonesia and FORUM-ASIA is to organise a two-day discussion on the review of the ToR of AICHR with the participation of civil society organisations, to positively influence the mechanism by providing input, foster better relationship between AICHR and other stakeholders, and support their works on human rights.
